These are the terms and conditions (the “Terms”) that apply to this customer survey prize draw (the “Prize Draw”). By entering the Prize Draw, each entrant agrees to these Terms and confirms they have read and understood the Lyst Privacy Notice at lyst.co.uk/help/privacy-policy/. For more information about how we process personal data in connection with the Prize Draw, please see the “Personal Data” section at the end of these Terms. Please also see how we limit our liability in the “Liability” section.
The Promoter of this Prize Draw is Lyst Ltd (company number: 07132083) of Floor 7, The Minster Building, 21 Mincing Lane, London EC3R 7AG (the "Promoter"). Enquiries about the Prize Draw can be sent by post to the above address or by email to uxteam@lyst.com.
The Prize Draw is free to enter and no purchase is necessary.
The Prize Draw is open only to legal residents of the United Kingdom (England, Wales, Scotland and Northern Ireland only) who are aged 18 and over at the time of entry.
Entrants are not eligible if, during the Prize Draw Period, they are (or they live with) or their immediate family member (parent, child, sibling and spouse of any of the foregoing) is an employee, representative, or agent of the Promoter or any of their subsidiaries, licensees or affiliates.
The Promoter reserves the right at any time to require proof of eligibility in such form as the Promoter considers necessary.
There is one (1) prize to be won in this Prize Draw, consisting of a £150 MyTheresa shopping voucher to be spent in the MyTheresa online store available at https://www.mytheresa.com/gb/en (the “Prize”). The Prize will be awarded via a random drawing.
The Prize is subject to the MyTheresa terms and conditions available at https://www.mytheresa.com/gb/en/terms-conditions. The winner is responsible for ensuring they are aware of any expiry dates and other terms and restrictions applicable to the use of the Prize.
The Prize winner is solely responsible for the reporting and payment of all applicable taxes (if any) relating to the Prize.
The Prize is non-exchangeable, non-transferable, non-refundable and no cash alternative is available. However, if it becomes necessary for reasons beyond the Promoter’s control, the Prize may be varied or swapped for a suitable alternative of the Promoter’s choosing.
To enter the Prize Draw, entrants must complete the Promoter’s customer survey (the “Survey”) available online at the link provided to you via email during the Prize Draw Period. All entrants must complete the Survey in its entirety. Incomplete Survey responses will be disqualified.
Only one entry into the Prize Draw per entrant is permitted. The Promoter reserves the right at any time to disqualify anyone found to have entered more than once, including by using multiple accounts or email addresses.
The content of a Survey response (whether positive or negative) will not in any way affect the entrant’s chances of winning. However, the Survey response must be completed in good faith and reflect the honest beliefs of the entrant. Survey responses must not be, or contain any material which is or is likely to be considered offensive, abusive, threatening, defamatory, obscene, indecent, sexually explicit, violent, discriminatory, false, misleading, or otherwise unlawful. Survey responses must not infringe any person’s intellectual property rights, rights of confidence, rights of privacy, rights under data protection legislation or any other legal right. Any Survey response that the Promoter considers to be in breach of these guidelines will be disregarded and the entrant’s entry will be disqualified.
The Promoter is responsible for administering the Prize Draw.
One (1) potential winner will be selected by a random drawing by the Promoter following the conclusion of the Prize Draw Period from among all eligible entries received.
The potential winner will be contacted by the Promoter by email within ten (10) business days of the end of the Prize Draw Period. Each entrant is responsible for monitoring for any Prize-related communications.
The potential winner must respond via email to the Promoter within fourteen (14) days of being contacted by the Promoter and confirm their full name and email address and provide valid identification (including proof of legal residence), as requested by the Promoter.
Subject to the Promoter’s verification of the winner’s eligibility and the Entrant’s compliance with these Terms, the Entrant will be declared the official winner of the Sweepstakes. If the potential winner does not comply with these Terms or is unable to be contacted or doesn’t respond to the initial notification within the specified timeframe, that potential winner will be disqualified and an alternative winner will be selected from the remaining eligible entries. Only three (3) alternate winners will be selected; after which, the Prize may go unawarded, at the Promoter’s discretion.
By entering the Prize Draw, each entrant agrees that, if they are a winner, the Promoter shall be entitled (but not obliged) to announce their name on the Promoter’s website and social media and in its marketing communications.
Entrants may be asked (without further reward) to take part in reasonable publicity connected with the Prize Draw, but they shall have no obligation to participate.
By entering the Prize Draw, each entrant acknowledges that if they win, their surname and county of residence may be disclosed to persons enquiring. Any entrant may object to their information being made available, or may request that the amount of information made available be reduced, by contacting the Promoter at uxteam@lyst.com. However, entrants acknowledge that the Promoter may disclose the relevant information, and their entry, in full to the UK’s Advertising Standards Authority if required (for example, to demonstrate that the Prize has been awarded). To request winner details, enquirers must submit a request to the Promoter at uxteam@lyst.com within one (1) month of the end of the Prize Draw Period. Details will only be disclosed (if permitted by law) after the Prize has been awarded.
The Promoter is not responsible for any late, lost, stolen, misdirected, misdelivered, incomplete, illegible, or unintelligible entries; unavailable network connections; failed, incomplete, garbled, or delayed computer transmission; online failures; hardware software or other technical malfunctions or disturbances; or any other communications/system failures or circumstances affecting, disrupting or corrupting the Prize Draw in any manner including without limitation, receipt of entries, eligibility in the Prize Draw, winner notification, or winner response to notification.
The Promoter is not responsible for any damage to the entrant’s computer or electronic equipment resulting from participation in the Prize Draw or downloading of any information necessary to participate in the Prize Draw.
By participating in this Prize Draw, entrants (including the winner) release the Promoter from any and all liability, damages or causes of action (however named or described) with respect to or arising out of participation in the Prize Draw, and/or the receipt or use/misuse of the Prize awarded, including, without limitation, liability for personal injury, death or property damage (except as explained below).
The Promoter (a) makes no warranty, guarantee or representation of any kind concerning the Prize and (b) disclaims any implied warranty.
Nothing in these Terms limits or excludes the Promoter’s liability for death or personal injury caused by its negligence, or for fraud, or for breach of the Consumer Rights Act 2015, or for any matter in respect of which liability cannot be lawfully limited or excluded.
The Prize Draw is in no way associated with or sponsored, endorsed or administered by any third party, including MyTheresa. By participating in the Prize Draw, entrants are providing information to the Promoter and not to any third party. All third-party trademarks and other intellectual property rights are hereby acknowledged.
The Promoter reserves the right to vary, suspend or cancel the Prize Draw and/or these Terms if it considers it necessary to do so, including if there is any actual or anticipated breach of applicable law or if variation, suspension or cancellation is necessary due to an event outside the Promoter’s reasonable control. In the event of cancellation, the Prize may be awarded to a winner drawn from entries received prior to cancellation.
Without limiting the Promoter’s options, the Promoter reserves the right at any time to disqualify entries or entrants that the Promoter regards as being in breach of these Terms, any applicable laws, any terms referred to in these Terms and/or the spirit of the Prize Draw.
Any attempt to damage or undermine the content or legitimate operation of the Prize Draw is prohibited and may also be a violation of criminal and/or civil laws. The Promoter reserves all its rights and remedies to deal with breaches or suspected breaches, including without limitation, to exclude any entrant or winner believed to be associated with such activity.
Any website on which these Terms are posted is only intended to be accessed from the United Kingdom and where permitted by law. The Promoter makes no representation that materials relating to the Prize Draw are appropriate or available for use at other locations. Access to them from territories where their contents are illegal is strictly prohibited.
If any part of these Terms is or becomes invalid or unenforceable, the validity and enforceability of the rest of these Terms will not be affected. The Promoter’s failure to enforce any provision of these Terms will not constitute a waiver of that provision.
Subject to the “Law and Jurisdiction” section below, if there is a dispute about the Prize Draw and/or these Terms, the Promoter’s decisions are final and binding and no correspondence will be entered into. If there is a conflict between these Terms and any document referred to in these Terms, these Terms take precedence to the extent necessary to resolve the conflict.
The Prize Draw is governed by the laws of England and Wales and all Entrants submit to the jurisdiction of the English courts.
The Promoter is the data controller in respect of any personal data of entrants that is collected and processed in connection with the Prize Draw.
Each entrant acknowledges that any personal data that is collected and processed in connection with the Prize Draw will be stored, processed and retained in accordance with the Promoter’s Privacy Notice which is available at lyst.co.uk/help/privacy-policy/.
The Promoter will process each entrant’s personal data for the purposes of administering the Prize Draw (including Prize fulfilment) and complying with the Promoter’s regulatory obligations in relation to the operation of the Prize Draw (including where required to disclose the winner’s details to persons enquiring and to the UK’s Advertising Standards Authority). It is necessary for the Promoter to use each entrant’s personal data in this way to perform its obligations to entrants in relation to the administration of the Prize Draw or it is in the Promoter’s legitimate interest to use each entrant’s personal data in this way to ensure the proper administration of the Prize Draw.
Survey responses may be used for user research to generate insights and carry out analytics about how entrants engage with the Survey and Lyst products and services, including the Lyst website and app. The entrant’s Survey responses may be combined with other information held by the Promoter about the entrant’s use of their Lyst account and the Lyst website and app (including their order and browsing history) to enhance the entrant’s Survey responses, to enhance the effectiveness of website and app developments and to improve the Lyst customer experience. Where personal data is used in this way, the personal data may be used together with information relating to other entrants who completed the Survey. It is in the Promoter’s legitimate interest to use entrants’ personal data in these ways to improve Lyst products and services and the Lyst customer experience.
